Source of Contributions: Employers are required to make
Contributions to the Fund. Participants are not permitted to make
Contributions on their own behalf. Benefits are paid according to Plan
provisions out of a trust fund which is used solely for this purpose and
for paying reasonable administrative expenses. A complete list of the
employers contributing to the Fund may be obtained upon written
request to the Fund and is available for examination at 140 Huguenot
Street, New Rochelle, New York 10801.
Collective Bargaining Agreements: The Plan is maintained
pursuant to various collective bargaining agreements between the
Contributing Employers and the Union. Two of the employer associations
maintaining the Plan are the Bronx Realty Advisory Board, Inc. and the
Boiler Service Maintenance and Repair Employers Association of New
York, Inc. Copies of collective bargaining agreements are available for
examination by Participants and Beneficiaries upon written request to
the Fund.
Interpretation of the Plan: The Trustees have the sole and
exclusive authority and discretion to interpret the provisions of the Plan.
The Trustees also have the sole and exclusive authority and discretion to
make factual determinations. The decisions of the Trustees shall be final
and binding on all parties. The Trustees may adopt such administrative
interpretations of this Plan as they consider necessary to carry out
the intent and purpose of the Plan and to provide for its effective
administration.
